Terms of Service

These Terms govern your use of BrightGenius, a product of Genius Learning, Inc. (“BrightGenius,” “we,” “us”). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use the service.

1. Who may use BrightGenius

You must be at least 18 years old and the parent or legal guardian of any child who uses the service. You are responsible for supervising your child's use and for all activity under your account.

2. What BrightGenius is

BrightGenius is an early-learning application that teaches reading (and, over time, other subjects) to young children through a guided, voice-led experience. It is an educational tool, not a substitute for a teacher, therapist, or professional assessment. We make no guarantee of specific learning outcomes; children progress at their own pace.

Keep your login credentials secure and don't share them. Notify us promptly of any unauthorized use. You're responsible for the accuracy of the information you provide, including the ages of children on your account.

All content in BrightGenius — including the curriculum, decodable stories, characters (such as Ollie), artwork, audio, and software — is owned by Genius Learning, Inc. or its licensors and is protected by law. We grant you a personal, non-transferable, non-exclusive license to use the service for your family's own educational use while your subscription is active.

Your use is also governed by our Privacy Policy and Children's Privacy Policy, which explain how we handle your and your child's information.

8. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Genius Learning, Inc. will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms. On termination, the license in Section 6 ends and your data is handled per our Privacy Policy.

11. Changes to these Terms

We may update these Terms. If changes are material, we'll notify account holders by email and update the effective date. Continued use after a change means you accept the updated Terms.

12. Governing law & contact
